Strict Liability Dog Bite Law

CT’s dog bite law (C.G.S § 22-357) makes a dog’s owner or keeper strictly liable for injuries caused by their dog. “Strict liability” means that, unlike in other injury cases, there’s no need to prove negligence in order to recover damages from the dog owner or keeper. (There are some exceptions – like where the person bit was teasing or tormenting the dog, or was trespassing, they aren’t protected by the dog bite law.)

The law is favorable to children under seven (7) years old. It makes the presumption that they weren’t teasing or tormenting the dog, shifting the burden to the owner or keeper to prove otherwise.

Common Dog Bite Injuries include:

  • Deep & serious lacerations to one’s face.
  • Fractured & crushed bones.
  • Muscle & nerve damage.
  • Infections, (like Cellulitis, needing I.V. antibiotic treatment).
  • Permanent scarring.
  • Need for Rabies vaccine.
  • Fear, anxiety, depression & post-traumatic stress induced by the dog attack.
